BY ENTERING AND PARTICIPATING IN THE CONTEST, ENTRANT (1) FULLY AND UNCONDITIONALLY AGREES TO ACCEPT AND BE BOUND BY THESE OFFICIAL CONTEST RULES AND BY ALL DECISIONS OF BLUEGRASS RADIO NETWORK, INC. (“BRN”), WHICH DECISIONS, INCLUDING, WITHOUT LIMITATION, DECISIONS REGARDING ELIGIBILITY, WINNERS AND THE INTERPRETATION OF THE TERMS USED IN THESE OFFICIAL CONTEST RULES, SHALL BE FINAL AND BINDING IN ALL RESPECTS; AND (2) REPRESENTS AND WARRANTS THAT ALL INFORMATION PROVIDED BY ENTRANT IN CONNECTION WITH THIS CONTEST IS TRUE, ACCURATE AND COMPLETE AS OF THE DATE OF ENTRY.

No purchase necessary. This contest is open to any individual who is at the time of entry (a) a legal resident of one of the 50 United States or the District of Columbia (excluding Guam, Puerto Rico, and all other U.S. and foreign territories and possessions) (the “Eligibility Area”); and (b) 21 years of age or older. VOID OUTSIDE OF THE ELIGIBILITY AREA AND WHERE OTHERWISE TAXED, PROHIBITED OR RESTRICTED BY LAW. Employees of BRN, its affiliated radio stations and agencies, sponsors, and members of the immediate families or households of such employees are not eligible.

LIMIT ONE ENTRY PER PERSON/HOUSEHOLD PER DAY. Multiple daily entries by a single entrant are VOID. Prize is not redeemable for cash and is not transferable. No prize will be awarded for a winner who declines the prize. Void where prohibited or restricted. Prize must be used between May 13th and May 31, 2010. Winner and guest must be 21 years of age or older and, where permitted by law, will be required to sign and return a liability/publicity release form and/or a completed IRS W-9 form prior to travel. All federal, state and local taxes on the prize are winner's sole responsibility. By accepting the prize, winner waives the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize and any and all liability that might arise from redeeming or seeking said prize.

Prize: One (1) grand prize will be awarded. Winner will be selected at random and shall receive:

• $500 in travel (redeemable only with trip)
• VIP Bluegrass Treatment

A travel allowance of $500 dollars is included in this prize (redeemable only with trip). It is winner's sole responsibility to arrange transportation to and from the winner's residence to Silver Dollar City. The total approximate retail value of all prizes to be awarded is $2,000.00 USD. The value of the prizes set forth above represents BRN’s good-faith determination of the maximum retail value thereof.

To enter, go to the BRN website located at http://www.bluegrassradio.com/contests/bluegrassbbq.html (the “Web Site”), complete the online entry form by entering your name, email address, complete mailing address, day/evening telephone numbers, date-of-birth, and click "submit" to enter the contest. Entries received through the Web Site must be received by Midnight CST on Wednesday, April 14, 2010. To send a contest entry by postal mail, print your name, complete mailing address, day/evening telephone numbers, date-of-birth and the words "BLUEGRASS & BBQ BASH” on a 3x5 card and mail to BRN, P.O. Box 112000, Nashville, TN 37222. All entries must be received by Midnight CST on Monday, April 12, 2010. All entries received by BRN after the end of the Contest Period will be discarded and deemed VOID. In the event of a dispute, all email entries will be deemed to have been submitted by the owner of the email account from which they were sent. All entries become the property of the sponsor and will not be returned.

Winner will be determined in a random drawing from all contest entries on or about April 15, 2010, by BRN, whose decisions will be final in all matters relating to this Contest. Odds of winning are determined by and depend upon the total number of eligible entries received. The use of robotic, automatic, macro, programmed or like methods (including without limitation the use of any promotion/contest subscription, notification, entry or like sites or service that offers contest entry services “on behalf of” entrant) is strictly prohibited. If you attempt to enter the contest in a manner other than as permitted in these Official Rules, then upon discovery thereof by BRN, your entry will be deemed void and ineligible and you may be disqualified from further participation in the contest. Proof of entering contest online will not be deemed by BRN to constitute proof of delivery or receipt of entry. No changes to any entry materials or information will be permitted once submitted.

Inability of BRN to contact a potential winner, or return of BRN emails or prize notification as “undeliverable” for any reason, may result in disqualification of such potential winner and selection of an alternate winner from among all remaining eligible entries. BRN reserves the right in its sole discretion to substitute with either the cash value of the applicable prize that would otherwise have been awarded, or a prize or prizes of equal or greater value, in the event that (i) such prize is unavailable, or (ii) the winner is unable to receive, accept or assume responsibility for the prize for any reason.

Neither BRN, Herschend Family Entertainment Corporation (hereinafter referred to as "Sponsor") nor any other contest Sponsors (the “Sponsors”) are responsible for late, lost, incomplete, stolen, ineligible or misdirected mail entries. Facsimiles or mechanical reproductions will not be accepted. BRN and the Sponsor(s) assume no responsibility for cancellation of the contest due to labor strike, terrorism, industry conditions, commercial viability, or any other cause beyond BRN’s reasonable control. No responsibility is assumed by BRN or the Sponso(s) for lost, late, incomplete, stolen, misdirected, mutilated, postage-due, illegible, unreadable, inaccurate, incorrect, inaccessible, corrupted or unusable online entries; incorrect or inaccurate online or printed information relating to the contest (including typographical errors); any computer, telephone, cable, network, satellite, server, service provider, electronic, power, or Internet or other hardware or software malfunctions, failures, connections or availability; data loss or late or incorrect data processing; Internet traffic congestion; service provider/Internet/Site inaccessibility, unavailability or malfunction; garbled or jumbled transmissions; or unauthorized human intervention. Although BRN and the Contest Entities attempt to ensure the integrity of the contest, neither the BRN nor the Contest Sponsor(s) are responsible for the actions of entrants or other individuals in connection with the Contest, including entrants’ or other individuals’ attempts to circumvent these Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Contest.

Without limiting any other provision of these Official Rules, BRN reserves the right, at any time and in its sole discretion, to disqualify and/or deem ineligible to participate in this Contest, any individual it suspects: have compromised the integrity of the Contest or to have tampered with the entry process or the operation of the Contest; to have failed to agree to these Official Rules; to be in violation of these Official Rules; to be acting in bad faith, or in a non-sportsmanlike or disruptive manner; or to be annoying, abusing, threatening or harassing any other person in connection with the Contest. ANY ATTEMPT TO DAMAGE THE SITE OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF THESE OFFICIAL RULES AS WELL AS CRIMINAL AND CIVIL LAWS. IF BRN BELIEVES OR BECOMES AWARE THAT SUCH AN ATTEMPT HAS BEEN, IS BEING OR WILL BE MADE, BRN RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY RESPONSIBLE ENTRANT(S) AND OTHER RESPONSIBLE INDIVIDUAL(S) TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING, WITHOUT LIMITATION, CRIMINAL PROSECUTION.

BY ENTERING THE CONTEST, ENTRANT AGREES TO DEFEND, INDEMNIFY AND HOLD BRN AND THE CONTEST SPONSOR(S) HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE CONTEST OR PARTICIPATION IN ANY CONTEST-RELATED ACTIVITY, OR RESULTING DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THE CONTEST, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION AND/OR INVASION OF PRIVACY. ENTRANT ALSO ACKNOWLEDGES THEY HAVE READ THE BRN PRIVACY POLICY POSTED ON COMPANY'S WEBSITE AND ACCEPT THE TERMS SET FORTH THEREIN.

BRN CONTROLS AND OPERATES THIS CONTEST FROM OUR OFFICE IN THE UNITED STATES OF AMERICA. THE SUBSTANTIVE LAWS (AS DISTINGUISHED FROM THE CHOICE OF LAW RULES) OF THE STATE OF TENNESSEE AND THE UNITED STATES OF AMERICA APPLICABLE TO CONTRACTS MADE AND PERFORMED ENTIRELY IN TENNESSEE AND WHERE THE RELEVANT CONTACTS ARE WITH SUCH STATE SHALL GOVERN (i) THE VALIDITY AND INTERPRETATION OF THESE OFFICIAL RULES; (ii) THE PERFORMANCE BY ENTRANT AND BRN OF THEIR RESPECTIVE OBLIGATIONS HEREUNDER; AND (iii) ALL OTHER CAUSES OF ACTION (WHETHER SOUNDING IN CONTRACT OR IN TORT) ARISING OUT OF OR RELATING TO THE CONTEST.

BRN AND THE SPONSORS MAKE NO WARRANTIES, AND HEREBY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, CONCERNING ANY PRIZE FURNISHED OR MADE AVAILABLE IN CONNECTION WITH THE CONTEST. IN NO EVENT WILL BRN OR THE SPONSOR(S) BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF ANY ACCESS TO AND/OR USE OF THE WEB SITE, OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF, OR PARTICIPATION IN, ANY PRIZE AWARDED IN CONNECTION WITH THE CONTEST.

ANY ACTION AGAINST BRN OR ANY SPONSOR IN CONNECTION WITH OR RELATED TO THIS CONTEST MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES.

The failure of BRN to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any provision contained in these Official Rules is found by a court of competent jurisdiction to be unlawful, invalid, or for any reason unenforceable, the parties nevertheless agree that portion shall be construed consistent with applicable law as nearly as possible to reflect the original intention of BRN, and that provision of these Official Rules shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.
